At present, reference products for e-cigarette testing are not available. Overall e-cigarette sales, as well as the total number of e-cigarette brands, increased by more than 46% between January 2020 and December 2022. Disposable e-cigarettes have nearly tripled in nicotine strength, quintupled in e-liquid capacity, and dropped in price by nearly 70% between 2017 and 2022.

The decision lends new credibility to vaping companies’ longstanding claim that their products can help blunt the toll of smoking, which is blamed for 480,000 U.S. deaths annually due to cancer, lung disease and heart disease. E-cigarettes have been sold in the U.S. since 2007 but in recent years their potential benefits for smokers have been overshadowed by their use by adolescents and teens. Vaping nicotine has not been thoroughly evaluated in scientific studies. A Foundation-led study presented at the 2024 Society for Research on Nicotine and Tobacco annual meeting found that monthly e-cigarette sales in California declined by 41% after statewide restrictions on the sale of flavored tobacco products took effect. However, the report also noted that the tobacco industry continues to market products to offset these declines, including non-menthol cigarettes that contain other cooling chemicals. Continuing to monitor flavored tobacco product sales is key to assessing policies like these and informing further policy development and implementation.
